Clinical Decision Support — Not Medical Advice

OpenFunctional provides AI-powered clinical decision support tools for licensed healthcare practitioners. The platform generates supplement and wellness recommendations based on patient-provided health data and lab results.

OpenFunctional does not provide medical advice, diagnosis, or treatment. All outputs are informational and intended to assist — not replace — the clinical judgment of a licensed practitioner. Every recommendation generated by the platform must be reviewed, validated, and approved by a qualified healthcare professional before being communicated to a patient.

No Patient-Practitioner Relationship

Use of OpenFunctional does not create a doctor-patient, practitioner-patient, or any other clinical relationship between the patient and OpenFunctional or its operators. The practitioner-patient relationship exists solely between the licensed professional and their patient.

Intellectual Property

The OpenFunctional platform, including its software, design, AI models, clinical protocols, branding, and documentation, is the intellectual property of OpenFunctional and its owners. You may not copy, modify, distribute, or create derivative works from any part of the platform without written permission.

Patient data submitted through the platform remains the property of the practitioner and their patients. We claim no ownership over health data.

Limitation of Liability

To the maximum extent permitted by law, OpenFunctional and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform. This includes, without limitation, damages for clinical outcomes, loss of data, loss of revenue, or interruption of service.

OpenFunctional is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Termination

We reserve the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these terms, misuse of the platform, or non-payment of applicable fees.

Upon termination, your right to use the platform ceases immediately. We will retain data in accordance with our Privacy Policy and applicable law.

Changes to These Terms

We may modify these terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of West Virginia.
